Acceptance of terms

The www.vinspired.com (and name variations including but not limited to www.vinspired.com www.vinspired.org www.vinspired.co.uk) (hereafter referred to as ‘the website’ or ‘this website’) is provided by vInspired.

By using or visiting this website including all content available through the www.vinspired.com domain name and its variations listed above, you agree to be legally bound by these terms and vInspired's privacy policy (published at vinspired.com/about/privacy-policy which shall take effect immediately on your first use of the website. If you do not agree to be legally bound by all the following terms please do not access and/or use the website.

We reserve the right to change or modify these terms at any time and will amend this page accordingly. It is your responsibility to periodically check this page for changes. By using this website you agree to accept any changes we may make whether you have read them or not.

In these Terms and Conditions the definitions shall have the meaning shown in the glossary.

Introduction

If you use the Website, you must comply with these Terms and Conditions.

Although you must read these Terms and Conditions in full, we think the most important points for you are:

(a) You must be over 16 or over or have parental consent to view or use the Website. You can only create a Profile and participate in Opportunities if you are between 14-25 (inclusive).

(b) You must comply with our House Rules when you contribute Content to the Website.

(c) The Provider websites are independent from us, and we have no control over the Opportunities they offer. vInspired is therefore not responsible and can accept no liability for the Opportunities.

(d) Just because an Opportunity is shown on the Website, does not mean it is available.

(e) We will only share the information you provide to us with other people or organisations in accordance with our Privacy Policy. We will do this, even if you have opted for a private Profile.

(f) If you do not want the Content you contribute to the Website to be made publicly available on the Website for other users to see, you can select a private Profile.

(a) Except as permitted in these Terms and Conditions, you may not alter the Website in any way or do anything that might or will damage or disrupt the good working order of the Website or our equipment or software.

(b) You agree that vInspired may at any time and without prior notice to you replace or amend these Terms and Conditions. Your continued use of this Website after amendments are made means you accept the Terms and Conditions as updated. You should therefore visit this page regularly to review the Terms and Conditions.

(c) You must be over 16 or over or have parental consent to view or use the Website. You must be between the ages of 14-25 (inclusive) to create a Profile and/or participate in an Opportunity.

(d) You must keep secret any password you have and not let any other person or organisation use it. You must notify us immediately of any suspected misuse of your password.

Accuracy

(a) vInspired does not guarantee that the information contained in the Website is accurate, verified or complete. v accepts no liability if you or any person or organisation relies on or uses the information.

(b) vInspired does not guarantee that the Website will be uninterrupted or error free, or that the Website or your use of it will be free of viruses or harmful material. You are responsible for ensuring that your computer is suitable to use the Website.

4. Information you provide to us

(a) You agree that any information you provide to us is true.

(b) Any information you provide to us through the Website will be treated in accordance with our Privacy Policy.

5. Online materials

Where content on the Website is supplied by others we do not control or endorse such content in any way.

6. Copyright and monitoring

The content of the Website is owned by vInspired or third parties. No content from the Website may be copied, used or reproduced without our written consent, except where it is used for research and non-commercial use where no consent is required. 7. Linked sites and Providers

(a) When you access any other website through the Website (including Provider websites) you understand that it is independent from vInspired and that we have no control over that website, or the services offered through it.

(b) Where an Opportunity is posted on the Website, we cannot guarantee that it will be available and vInspired has no control over its availability.

Liability

(a) In circumstances where you suffer loss or damage arising out of or in connection with the use of the Website, we accept no liability.

(b) vInspired accepts no responsibility for any loss or damage caused or alleged to be caused by your participation in an Opportunity. Any concerns or complaints regarding any Opportunity should be directed to the Provider.

(c) vInspired shall not be liable for any loss or damage caused or alleged to be caused by your use of another website or resource. Any concerns regarding any external link should be directed to info@vinspired.com immediately.

(d) If we are liable to you for any reason, our liability will be limited to £200. (This limit does not apply to any liability we may have for death or personal injury resulting from our negligence or fraudulent misrepresentation).

General

(a) We may assign, transfer, replace vInspired or subcontract any or all of our rights and obligations under these Terms and Conditions at any time.

(b) If any term of these Terms and Conditions is illegal, invalid or unenforceable for any reason, the remaining terms shall continue to be valid.

(c) These Terms and Conditions and your use of the Website are governed by English law and you are subject to the non-exclusive jurisdiction of the English courts.

(d) Except in respect of a payment obligation to vInspired, neither you nor vInspired will be held liable for any failure to perform any obligation to the other due to causes beyond your reasonable control.

(e) Failure or delay by either party to enforce an obligation or exercise a right under these Terms and Conditions shall not be a waiver of that obligation or right.

(f) Except where Providers are provided with rights under these Terms and Conditions, these Terms and Conditions do not confer any rights on any person or party (other than you and/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999.

10. Notices

10.1 All contact or notices to be given in relation to these Terms and Conditions or your use of the Website shall be given:

10.1.1 to us via e-mail to info@vinspired.com; or

10.1.2 to you, via these Terms and Conditions or at the email address you provide when creating your Profile (or later update).

10.2 Notice will be deemed received when an e-mail is received in full.

House Rules

If you upload any Content to the Site, you agree to accept the following house rules at all times:

(a) You must not post or upload any Content or use the Website in a way that breaches any law.

(b) You must not post or upload any Content or use the Website in a way that is offensive, threatening, defamatory, vulgar, obscene, harassing, false, misleading or unreliable, or that brings or is likely to bring the Website or vInspired into disrepute.

(c) You agree to not contribute Content that will infringe another user’s, organisation’s or person’s rights (including rights of privacy or publicity).

(d) Neither vInspired nor any Provider moderates any Content posted to the Website. v accepts no responsibility for any Content, but reserves the right to remove/edit any Content at any time.

(e) You are wholly responsible for all Content posted by you on the Website and for materials (including but not limited to emails) sent by you in connection to the Website.

(f) Please let us know immediately by contacting us at info@vinspired.com if any of these rules are broken by you or other users, or if you have any concerns about material posted to the Website.

(g) Using your access to the Website to send unsolicited bulk email or spam is forbidden.

(h) We and/or any Provider reserve the right to suspend or terminate your access to the Website immediately at any time.

(i) We and/or any Provider reserve the right to edit, or require you to edit, Content posted to the Website at any time.

(j) Any Content you post to the Website may be used by vInspired for any purpose subject to our Privacy Policy.

(k) If your use of the Website, uploading of Content or breach of these Terms and Conditions creates losses for vInspired, you will compensate vInspired for all its losses (including direct and indirect losses, all costs and damages).

(l) If your access to the Website is terminated or suspended for any reason, you must not access the Website or any other vInspired website or create a new Profile without our prior consent.

Glossary

(c) “Content” refers to any user generated content posted, attached or added to the Website including but not limited to any commentary, emails, information, screenshots, photographs, pictures, videos, text and artwork.

(d) “House Rules” refers to the house rules that form part of these Terms and Conditions.

(e) “Opportunity” or “Opportunities” refer to any volunteering activities (including but not limited to projects and events) offered to users on the Website through a Provider.

(f) “Providers” refers to organisations volunteering activities to users through the Website.

(g) The “Privacy Policy” refers to the privacy policy that forms part of the Terms and Conditions.

(h) “Programme” refers to the vInspired programme, a volunteering programme run by vInspired and facilitated through the Website (through which Providers can offer and arrange Opportunities for you).

(i) “Profile” refers to any profile you create during your use of the Website.

(j) “Terms and Conditions” refers to these Terms and Conditions, including the House Rules and Privacy Policy as updated or amended from time to time.

(k) “vInspired”, "v" “our”, “we” or “us” refer to vInspired (for details about us please see the end of these Terms and Conditions).
